Biography

Mark joined Wise Carter upon graduation from Vanderbilt Law School in 1987. He has been an active member of the firm’s healthcare section since that time, and he provides a wide range of corporate, regulatory and litigation services for clients, many of whom he has served for more than twenty five years.

He is legal counsel for numerous hospitals, physician groups, ancillary service providers and other healthcare interests operating in Mississippi and neighboring states.

Mark regularly counsels clients on regulatory compliance issues, including Stark, HIPAA and Medicare Fraud and Abuse rules. He handles a wide variety of commercial transactions for the firm’s clients, including acquisitions, leases, management service agreements, employment and recruiting contracts, and alternate payment model arrangements.

On the litigation side of his practice, Mark has successfully concluded hundreds of lawsuits, including commercial contract disputes, qui tam whistle blower actions, and professional liability claims.

He assisted with drafting the current version of the Mississippi Tort Claims Act, which provides the exclusive remedial framework for tort claims against community hospitals and other governmental entities in Mississippi. He regularly drafts policies and procedures to assist clients with their compliance efforts, including those related to EMTALA, HIPAA, patient consent, and advance directives.

He is a former chair of the Health Law Section of the Mississippi Bar and is an active member of the American Health Lawyers Association and the Health Law Section of the American Bar Association. When not working, he enjoys travel, cycling, fishing and playing guitar.
